1. Acceptance of Terms
By accessing or using Game Framework's website (gameframework.dev), cloud platform, SDK, or CLI tools (collectively, the "Services"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Services.
2. Description of Services
Game Framework provides:
- Game Framework SDK — An open-source (MIT License) Dart/Flutter SDK for embedding game engines into Flutter applications.
- Game CLI — A command-line tool for project setup, building, and publishing.
- Cloud Platform — A hosted service for package hosting, version management, team collaboration, and artifact storage, available in free and paid tiers.
3. Accounts
You must create an account to use the cloud platform. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate and complete registration information and to notify us immediately of any unauthorized use.
4. Subscription Plans and Payment
Free Tier
The free plan provides limited storage, bandwidth, and features as described on our pricing page. Free tier availability and limits may change with reasonable notice.
Paid Plans
Paid subscriptions are billed monthly per seat at the rate displayed at the time of purchase. Payment is processed through Stripe. All fees are non-refundable except as required by applicable law.
Changes to Pricing
We may change pricing with 30 days' notice. Continued use after a pricing change constitutes acceptance of the new pricing.
5. Acceptable Use
You agree not to:
- Upload malicious code, malware, or content that infringes on the rights of others
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the Services to violate any applicable law or regulation
- Interfere with or disrupt the integrity or performance of the Services
- Resell or redistribute the cloud platform without authorization
- Exceed your plan's rate limits through automated means designed to circumvent restrictions
- Use the Services for cryptocurrency mining or other compute-intensive activities unrelated to game development
6. Packages and Content
You retain ownership of all packages and content you upload to the platform. By publishing a package, you grant Game Framework a limited license to store, serve, and cache the package as necessary to provide the Services.
You are responsible for ensuring you have the right to publish any content you upload. You must not publish packages containing proprietary code, assets, or intellectual property belonging to third parties without proper authorization.
7. API Keys and Access Tokens
API keys and access tokens are credentials equivalent to your password. You are responsible for keeping them secure. Do not share API keys in public repositories, client-side code, or insecure channels. Game Framework is not liable for unauthorized access resulting from compromised credentials.
8. Open-Source SDK
The Game Framework SDK is licensed under the MIT License. Your use of the SDK is governed by the MIT License terms, not these Terms of Use. These Terms of Use govern your use of the cloud platform and website only.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We are not liable for any losses resulting from service interruptions.
10. Data and Backups
While we take reasonable measures to protect your data, you are responsible for maintaining your own backups of published packages. If you use custom storage, you are solely responsible for the availability and integrity of data stored in your own infrastructure.
11. Termination
You may close your account at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Services ceases immediately. We may retain certain data as required by law or for legitimate business purposes.
12. Intellectual Property
The Game Framework name, logo, website design, and cloud platform are proprietary. The Game Framework SDK is open-source under the MIT License. Nothing in these Terms grants you rights to our trademarks or proprietary elements beyond what is necessary to use the Services.
13. Limitation of Liability
To the maximum extent permitted by law, Game Framework shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising from your use of the Services.
Our total liability for any claims arising from the Services shall not exceed the amount you paid us in the 12 months preceding the claim.
14. Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
15. Indemnification
You agree to indemnify and hold harmless Game Framework and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Game Framework operates, without regard to conflict of law principles.
17. Changes to Terms
We may update these Terms periodically. We will notify users of material changes via email or a notice on the website. Continued use after changes constitutes acceptance.
